How overtime works (FLSA)
The Fair Labor Standards Act requires at least 1.5× your regular rate for every hour over 40 in a workweek for non-exempt employees (most hourly jobs).
Some states go further: California pays 1.5× after 8 hours in a day (2× after 12), and Alaska, Nevada, and Colorado have their own daily thresholds. The rule most favorable to you applies.
Salaried executive, administrative, or professional roles above the federal salary threshold can be exempt — no overtime entitlement. If you're paid hourly, you're almost always non-exempt.
Is overtime taxed more? No — see the numbers
The myth: “overtime pushes me into a higher bracket and I lose money”. The reality: only the extra dollars are taxed at your marginal rate — your base pay never pays more. At $20/hour with 10 overtime hours a week, the extra gross is $15,600 a year and a single filer keeps $13,159 (~84%). Working more never shrinks your take-home. The "no tax on overtime" deduction (2025–2028)
Under OBBBA, the premiumportion of your FLSA overtime — the “half” in time-and-a-half — is deductible from federal taxable income: up to $12,500 a year ($25,000 married), phasing out $100 per $1,000 of MAGI above $150,000 ($300,000 married). In the example above ($20/hour, 10 OT hours), the annual premium is $5,200and the calculator already deducts it — that's why you keep ~84% of the extra pay. FICA and state tax still apply.
